Terms of Service - Custom Mould In-Ear Monitors
Welcome to Victorious Audio! These Terms of Service ("Terms") govern the sale and use of custom mould in-ear monitors ("Product") and services provided by Victorious Audio.
Ordering and Payment
By placing an order for the Product, you agree to pay the specified price for the selected item(s) along with any applicable taxes and shipping fees in full and in advance. Payments are to be made via electronic fund transfer,” EFT”. The customer is responsible for using the e correct account and reference number.
Customization Process
Upon receiving your order, Victorius Audio will provide instructions for obtaining ear impressions. It is your responsibility to ensure the accuracy and quality of the ear impressions provided.
Production and Delivery
The production time for custom mould in-ear monitors varies and is subject to change based on factors such as order volume and production capacity. Victorious Audio is not liable for delays in production or delivery caused by unforeseen circumstances such as natural disasters, accidents or supplier delays.
Returns and Refunds
Due to the personalized nature of the custom mould in-ear monitors, Victorious Audio does not accept returns or offer refunds unless the Product is defective or does not match the specifications of your order. If you believe the Product is defective or incorrect, please contact us within 7 days of receiving it to initiate a return or exchange process. We do not offer refunds of custom in-ear monitors for reasons related to sound signature preferences.
Warranty
We warrant our custom mould in-ear monitors against defects in materials and workmanship for a period of 2 years from the date of purchase. The warranty extends to factory defects only and does not cover misuse of the product. If you believe that damage to your Product is covered under warranty, please contact us to initiate a warranty claim.
30 Day Fit Guarantee
Because of the many variables involved in creating a custom product, sometimes a fit adjustment is needed. Victorious Audio offers a 30 Day Fit Guarantee (on approved impressions) to ensure that your IEMs fit comfortably and retain a proper seal. Victorious Audio requires that you notify us within 30 days of receiving your Product to be covered by the 30 Day Fit Guarantee. If a fit adjustment is required, we'll need the Product to be sent back to be rebuilt for which new impressions may be required. In some cases, prior to starting the rebuild process, empty test shells may be sent to you to determine if the adjustments have corrected the fit issue. The cusomer is responsible for the cost of shipping your Product back to Victorious Audio. Victorious Audio will however cover the cost of shipping the refitted/rebuilt Product back to you.
Service and Repairs
Victorious Audio Offers serviceability and repair at the expense of the customer for up to 4 years after receiving an order. This includes re-shelling and replacement of drivers and connectors outside the circumstance of the 2-year warranty. This is to cover damages and wear that Victorious audio is not responsible for.
Cable Warranty
Cables are guaranteed not to be dead on arrival and have a 90-Day limited warranty from the original shipping date. This warranty does not cover damage caused by accident, excessive bending, excessive stress and overheating.
Limitation of Liability
In no event shall Victorious Audio or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Product. Our total liability for any claim arising from or relating to these Terms or the Product shall not exceed the amount paid by you for the Product.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of South Africa.
Amendments
Victorious Audio reserves the right to amend these Terms at any time by posting the amended terms on our website or notifying you via email. Your continued use of our Product after any such changes constitutes your acceptance of the amended Terms.
